DECLARATION & RELEASE TERMS

Not Your Mother’s Haircare Insiders Community Monthly Sweepstakes (the “Contest”)

By agreeing to these declaration and release terms (the “Declaration”), you (the “Winner”) will be awarded the prize (each, a “Prize”) described in the official rules and regulations of the Contest (the “Contest Rules”) located at: https://www.dofeelthink.com/sweepstakes. Capitalized terms not otherwise defined herein shall have the meaning given to such terms in the Contest Rules. All costs, taxes, fees, and expenses associated with any element of the Prize not specifically addressed herein or in the Contest Rules of the Contest, are the sole responsibility of the Winner. All federal, state and local taxes on the Prize are the Winner’s sole responsibility. 

Declaration and Release

In consideration of being selected as a Winner, I hereby confirm and agree that:

1.     I have received, read, understood, complied with and will comply with the Contest Rules; 

2.     My participation in the Contest is subject to the Contest Rules;

3.     I am a legal resident of one of the following: Canada (excluding Quebec), the United States (including Washington DC and excluding Puerto Rico) the United Kingdom or the Republic of Ireland (together, the “Promotion Territories”); 

4.     I am eighteen (18) years or older, or have attained the age of majority in my jurisdiction;

5.     I am (i) not an employee of the Administrator, the Sponsor or other companies associated with the promotion of the Contest, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies, or (ii) not an immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible;

6.     I accept the Prize as described in the Contest Rules and as awarded, and recognize that it cannot be transferred to another person, replaced by any other prize nor exchanged in whole or in part for money;

7.     I authorize the Administrator and their representatives or assigns to use, if need be, my name, video, image, information provided to the Administrator in regard to the Prize, without any form of compensation;

8.     I release, indemnify and forever discharge the Administrator, the Sponsor and any third parties related to the Contest and all of their respective employees, directors, officers, shareholders, agents, successors and assigns (the “Released Parties”) from, and waive as against the Released Parties, all recourses, losses or damages including any consequential losses or damages, actions, causes of action, suits, debts, dues, accounts, bonds, covenants, contracts, claims and demands whatsoever including, without limitation, any claim based on the loss of ability to earn income, claims for injury, death, illness, delay or cancellation arising out of the Prize (collectively, “Claims”), which I now have or hereafter can, shall or may have for or by reason of or in any way arsing out of the Contest, including, without limitation, any Claims arising out of my subsequent use of the Prize, whether such Claims arising in contract, by reason of negligence, or by reason of breach of duty realised by statute or in any other manner whatsoever;

9.     The provisions of this Declaration shall inure to the benefit of the respective heirs, executors, administrators, legal personal representatives, successors and assigns of the Released Parties and shall be binding upon my heirs, executors, administrators, legal personal representatives, successors and assigns;

10.  The provisions of this Declaration shall be governed by and interpreted in accordance with the laws of the Promotion Territory in which I reside and any disputes are subject to the dispute resolution terms set forth in the Contest Rules;

11.  I agree to return immediately, upon demand from the Administrator, the Prize, or the value of the Prize, which has been awarded to me if any statement made by me in this Declaration is false or misleading; and

12.  I have read the contents of this Declaration and I fully understand and agree to all of its provisions. I have had the opportunity to seek independent legal advice, and in the event I did not avail myself to that opportunity, I did so voluntarily and without any undue pressure and I agree that my failure to obtain independent legal advice may not be used as a defence to the enforcement of this Declaration.
